By creating an account or using the CreateArt mobile app ("App", "Service"), you agree to be bound by these Terms & Conditions ("Terms") and our [Privacy Policy]. If you do not agree, do not use the App.
You must be at least 18 years old to create an account and use CreateArt. By creating an account, you confirm you meet this requirement.
CreateArt provides a catalog of posters, festival posts, business and greeting templates, and frames, along with an in-app editor to customize and export designs. Some content and features require an active premium subscription.
You're responsible for:
Notify us immediately if you suspect unauthorized access to your account.
You retain ownership of designs, photos, and content you create or upload using the App ("Your Content"). By using the App, you grant us a limited, non-exclusive license to store, process, and display Your Content solely as needed to provide the Service to you (e.g. saving your drafts, rendering your exports).
You're responsible for ensuring Your Content doesn't infringe anyone else's rights or violate any law. We may remove content that violates these Terms.
Templates, posters, frames, watermarks, and other catalog content provided by CreateArt ("Our Content") remain the property of CREATE ART or our licensors. Subject to your compliance with these Terms and, where applicable, an active premium subscription, we grant you a limited, non-exclusive, non-transferable license to use Our Content to create designs for your personal or business use.
You may not:
Premium subscriptions and paid services are billed through Razorpay, our third-party payment processor, using the payment method you provide at checkout (card, UPI, netbanking, etc.). We do not process or store your full payment card details, which never pass through our servers.
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. The price and duration of your plan are shown before you confirm purchase.
You may cancel your subscription at any time from within the App (Settings → Account → Subscription). Cancelling stops future renewals — your access continues until the end of the current billing period you've already paid for.
We do not provide refunds for partial subscription periods, whether you cancel or the account is later restricted for a Terms violation, except where required by applicable Indian consumer protection law.
You agree not to:
We have zero tolerance for child sexual abuse and exploitation ("CSAE"). You may not use the App to create, upload, store, transmit, or request any content that sexually exploits, abuses, or endangers a minor, or otherwise engage in conduct that endangers children. Any such content or conduct will be removed and reported to the National Center for Missing & Exploited Children (NCMEC) or the relevant Indian authority, and the associated account will be permanently terminated. The App relies on third-party services (Google Firebase, Razorpay, Google Play Store) that have their own terms and privacy policies. Your use of features involving these services is also subject to those third parties' terms.
You may delete your account at any time from within the App (Settings → Account → Delete Account). This is the primary and recommended way to delete your account and associated data. A web-based fallback request form is also available; see our Account Deletion page for details on how that process works and its timeline.
We may suspend or terminate your account if you violate these Terms.
The App is provided "as is" and "as available." We don't guarantee the App will be uninterrupted, error-free, or that content will meet your specific requirements. To the extent permitted by law, we disclaim all warranties, express or implied.
To the extent permitted by applicable Indian law, CREATE ART will not be liable for any indirect, incidental, or consequential damages arising from your use of the App. Our total liability for any claim relating to the Service is limited to the amount you paid us in the [3/6/12] months preceding the claim, or a nominal amount if you haven't made any payments.
You agree to indemnify and hold [LEGAL ENTITY NAME] harmless from any claims arising from Your Content, your violation of these Terms, or your violation of any third party's rights.
We may update these Terms from time to time. If changes are material, we'll ask you to re-confirm your acceptance the next time you open the App. Continued use after that point means you accept the updated Terms.
These Terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts of Ahmedabad, Gujarat.
